Terms of Service

1. About Marmalade
Marmalade is operated by East Hill SASU, a company registered in France (RCS Paris 130 366 065), 173 rue de Courcelles, 75017 Paris. Marmalade is a private family sharing app that helps families collect moments throughout the week and compiles them into a beautifully printed magazine delivered to your door. By using Marmalade, you agree to these terms.
2. Eligibility
You must be at least 18 years old to create an account. Marmalade is designed for adults — parents, grandparents, and family members. If you are under 18, you may not create an account.
3. Your Account
You are responsible for keeping your login credentials secure and for all activity that takes place under your account. Please provide accurate information when creating your account. Each account is for a single person.
4. The Service
Marmalade lets family members share photos and captions within a private family. The service generates printed newsletters from your shared content and delivers them by post to UK addresses. An edition is printed only when your family has shared at least 5 moments since the last one (see section 8). We may introduce new features and expand the service over time.
5. Your Content
You retain full ownership of the photos, captions, and other content you share on Marmalade. By uploading content, you grant Marmalade a limited licence solely to store, process, format, resize, display, and print your content as part of operating the service (for example, including your photos in your family newsletter). This licence ends when you delete your content or your account.
When you share photos that include other people (including children), you are responsible for having a lawful basis to do so. If photos include children who are not part of your family, you should have permission from their parent or guardian before uploading.
6. Acceptable Use
Please use Marmalade respectfully. You agree not to upload content that is illegal, harmful, or offensive. Automated access, scraping, or any use that interferes with the service is not permitted. We may remove content that violates these terms.
7. Photos of Children
Marmalade is a private family service. We expect that photos shared within your family may include children. You are responsible for ensuring you have appropriate permission to share images of any child. If you are not a member of a Marmalade family but believe a photo of your child has been shared without your consent, please contact us at admin@marmalade.family and we will investigate and remove the content if appropriate.
8. Subscriptions and Payment
Payments are processed securely via Stripe. Your subscription covers the ongoing service that stores the moments you share and prepares each edition, together with the printing and postal delivery of your family newsletter. Prices are shown in GBP. We will give you at least 30 days notice before any price changes take effect. Subscriptions renew automatically until you cancel. You have 14 days from the day you subscribe to change your mind, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To cancel, use the app or write to admin@marmalade.family. Any clear statement is enough, and a model form is given in section 11. An edition that has already been printed is not refunded, because it is made from your family’s own moments and cannot be returned.
An edition needs at least 5 shared moments to be printed. If your family has shared fewer than 5 moments by the print date, no edition is printed for that cycle. The subscription charge for the cycle still applies, as it covers the ongoing service, and it is not refunded. The moments already shared are kept and go into your next edition.
In addition to the subscription, any member of a family can chip in towards the family’s renewals with a one-off payment. Chip-ins are also processed via Stripe and are governed by section 9 below.
9. Chip-ins
A chip-in is a gift towards your family’s Marmalade renewals. Any member of the family can chip in, in GBP, whether or not they are the family admin. Chip-ins are held as a balance for that family and are used only to pay its renewals: at each renewal the balance is used first when it covers the full amount, and the admin’s card pays otherwise.
Chip-ins have no cash value and are not refundable as cash, except where the law requires it. They are not transferable: they cannot be moved between families, sold, or assigned to any other person, and they cannot be spent on anything other than that family’s renewals.
If the plan ends, the balance is kept with the family and is used again if the plan restarts. Balances previously shown in the app as Jam are chip-ins under these terms.
A chip-in balance is not a payment instrument, a wallet, electronic money, or a payment service, and is not regulated by the Financial Conduct Authority. It is a closed-loop credit for Marmalade’s own service, in the same category as a single-retailer gift balance.
10. Delivery
Newsletters are delivered to the UK postal address you provide. Delivery timescales are estimates and may vary. If a newsletter is lost in the post, please email admin@marmalade.family and we will arrange a reprint.
11. Cancellation
You can cancel your subscription at any time through the app. Editions that have already been printed are not eligible for a refund. After cancellation, your subscription remains active until the end of the current billing period and no further editions will be printed.
When the admin cancels, the other members of the family are told and any of them can take the plan over before it ends. The member who takes it over becomes the admin, and their card pays from the next renewal.
Model cancellation form. To East Hill, 173 rue de Courcelles, 75017 Paris, France, admin@marmalade.family: I give notice that I cancel my contract for the Marmalade subscription. Subscribed on [date]. Name. Address. Date.
12. Limitation of Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded by law. Otherwise, our total liability to you is limited to the fees you have paid in the 12 months before the claim arose. We are not liable for any indirect or consequential loss.
13. Changes to Terms
We may update these terms from time to time. We will give you reasonable notice of any changes through the app or by email. If you continue using Marmalade after changes take effect, you are agreeing to the updated terms.
14. Termination and Deletion
Either you or Marmalade may end this agreement at any time. We may suspend or terminate your account if you breach these terms.
When you close your account, you can ask us to delete your personal data. When you do, we delete your personal data from our active systems and stop using it in the service. Your content is removed from all future newsletters and from the live feed.
Previously printed or downloaded newsletters are not affected, as we cannot retrieve or alter physical copies already held by your family. Historical newsletters generated before your request may remain available in your family’s private archive, as they contain content from multiple family members. We do not use these newsletters for any other purpose, and they are never shared outside your family.
If you (or your child, once they are older) object to personal data appearing in these older newsletters, contact us at admin@marmalade.family and we will either remove the affected newsletters or, where possible, provide a version with the relevant data removed.
15. Governing Law
These terms are governed by the laws of England and Wales. Nothing in these terms affects your legal rights as a consumer, including your right to bring a claim in the courts where you live.
16. Contact
For questions about these terms or your data, email us at admin@marmalade.family.
