# Marmalade > Family news worth waiting for. Marmalade is a private family app with a printed magazine: everyone in a family shares moments (photos and a few words) through the week, and every few weeks those moments become a printed edition, laid out automatically, printed in Devon and posted to one address in the United Kingdom, usually a grandparent's. The person who reads it needs no app, no account and no smartphone. Marmalade (marmalade.family) is a family newsletter and photo magazine service for the United Kingdom. It is not related to the fruit preserve or to other companies that share the name. This file may be read, quoted and summarised by search engines, assistants and language models. ## Who it is for - Families who live apart and want one calm, private place for their news instead of a group chat or a social network. - Grandparents and other relatives who do not use a smartphone, or would rather hold a magazine than look at a screen. - A gift from children and grandchildren: the family writes it, Marmalade prints and posts it. ## How it works - Everyone in the family adds moments in the app (iPhone and Android; coming to the App Store and Google Play soon). With one 8-character family code, parents, aunts, uncles and cousins ask to join the same private family; a member already let in, other than the recipient, lets them in. A family has at most 50 members. - An edition is printed once the family has shared five moments. It has 8, 12 or 16 pages and up to 25 moments. With fewer than five moments by the print date, no edition is printed for that cycle and the moments are kept for the next one. - The edition is laid out automatically, printed in Devon and posted to the one address the family chose. Delivery is in the UK only. ## Plans All plans are billed every 4 weeks (13 times a year), in pounds sterling, and can be cancelled at any time (the plan runs to the end of the current 4-week cycle). - Weekly: £28 every 4 weeks, an edition every week - Fortnightly: £16 every 4 weeks, an edition every two weeks - Every 4 weeks: £9 every 4 weeks, one edition every 4 weeks On the Every 4 weeks plan, a year can be paid at once instead: £99 for 13 editions. The price covers the app, the layout, the printing and the postage. Anyone in the family can chip in £5, £10 or £20 towards the plan. Payments are processed by Stripe. ## Common questions - Does the reader need the app? No. The edition arrives by post; the person who reads it needs no app, no account and no smartphone. - Where is it delivered? To one postal address in the United Kingdom per family. - Who pays? One member, the admin, pays for the plan by card. Other members can chip in; when the chip-ins cover a whole renewal, it is paid from them and the admin's card is not charged. - How do you cancel? In the app, at any time. The plan runs to the end of the 4 weeks already paid for. Each edition is made from the family's own moments, so the right to cancel does not apply and a payment is not refunded on a change of mind. - What if an edition does not arrive? If it has not arrived within 10 working days of the posting notice, or arrives damaged, write to admin@marmalade.family: it is reprinted or refunded. - Who can see a family's moments? Only the members of that family. Nothing is public, and Marmalade never uses moments for marketing. - Who can join? Adults aged 18 or over who hold the family code, once a member of the family, other than the recipient, lets them in. Moments may show children. ## Privacy A family is private. Only its members see its moments; nothing is public, and nobody can find or join a family without its code. ## Company Marmalade is operated by East Hill, a French company (SASU) registered in Paris. Who We Are Marmalade is a private family sharing service with a printed edition. The data controller is East Hill SASU, a company registered in France (RCS Paris 130 366 065), 173 rue de Courcelles, 75017 Paris. East Hill is registered with the UK Information Commissioner’s Office as a data controller, under reference ZC278702. You can reach us at admin@marmalade.family. ## 2. What We Collect For each kind of data: why we use it, the lawful basis (section 3) and how long we keep it. - Name and email address: to run your account. The members of each family you belong to see both. Basis: contract; for showing your email address to them, legitimate interest - Phone number and date of birth, if you add them. Basis: consent - Your profile picture, comments, reactions and the special dates you add, and the name and email Apple or Google give us if you sign in with them. Basis: contract - Photos and captions, which may include children, shared by their parents or guardians within private families: shown to your family and printed in its editions. Basis: contract; for children’s data, legitimate interest - The person who receives the editions: the name and address the admin gives us, and their birthday and photo if the admin adds them. Used only to print and post the editions. Basis: contract. Deleted 100 days after the plan ends. If you receive editions and want them to stop, write to admin@marmalade.family - Records of your agreement, each time you tick a box or tap a button to agree (creating your account, starting or taking over a plan, becoming the admin by adding a card, choosing the year, chipping in): the words shown, the time, the versions of the Terms of Service and of this policy shown, the app version and your type of device. Basis: legitimate interest. Kept 6 years after the end of the plan they concern, or, for those given when you created your account, 6 years after it is closed - Payments: Stripe processes them. We do not store your card number, only its last four digits and expiry date. Basis: contract. Payment records, with the name of the person who paid, are kept 10 years, as French accounting law requires - Codes: which code an admin entered and what it gave. For another family’s code, also which family recommended yours; neither family is told who the other is. Basis: contract. Kept with the payment records - A copy of an identity document, asked for a refund of a chip-in balance, to check who is refunded. Basis: legitimate interest (preventing fraud). Deleted 30 days after paying - Reports and blocks: when you report a moment, a comment or a member, we keep the report and who sent it, to keep families safe; nobody in your family is told who. Basis: legitimate interest (keeping families safe). 12 months after a report is closed, we erase who sent it and their note and keep the rest, unless the law or a dispute about the decision requires us to keep them longer. We also keep the list of members you have blocked - Push notification tokens and your device type: to send the notifications you have asked for. Basis: consent - Device information, crash and performance reports, sent to Sentry with your account id, never your photos, captions or name: to fix errors and improve the service. Basis: legitimate interest. Crash reports are kept 90 days - Usage events (such as app opened or moment shared), kept in our own database with your account id. Basis: legitimate interest. Deleted after 180 days ## 3. Lawful Basis for Processing Two laws protect your data: the UK GDPR, because Marmalade is offered to people in the United Kingdom, and the EU GDPR, because East Hill is established in France. The lawful bases are the same in both, save for payment records. Where we rely on legitimate interest, the interest is: - Usage events, error tracking, service security and improvement: running a private family service safely and keeping the app stable - Showing your email address to the other members of your families: letting the members of a family recognise one another and keep in touch about its plan and editions. It is shown only to people who joined a family with you, which you chose to join, never outside it; we consider that this does not override your interests - Records of your agreement: being able to show what was agreed and when - Children’s data in photos and captions: the shared interest of the family and Marmalade in a private family sharing service with a printed edition, balanced against the child’s rights and interests - Payment records: under the EU GDPR the basis is legal obligation (French accounting law requires us to keep them); under the UK GDPR it is legitimate interest, keeping the accounts that the law of our country of establishment requires ## 4. How We Use Your Data We use your data as section 2 describes: to run Marmalade, prepare and print your family’s editions, process payments, send the notifications you have opted into, improve the service and prevent abuse. We never use anyone’s photos or captions for marketing, for advertising or to train models, and we do not use face recognition. ## 5. Who We Share Data With The members of your family see what you share, your name and your email address. The person who receives the edition reads what is printed in it. We may disclose data where the law requires it. Our service providers: - Supabase (hosting and database) — European Union (Sweden) - Stripe (payment processing) — US, PCI DSS compliant - Sentry (error tracking) — European Union (Germany) - Resend (email delivery) — US - Expo, Apple and Google (push notification delivery) — US - Google Cloud (edition rendering and our nightly backup) — UK - PDFShift (backup edition rendering) — France, and may process in the US - Stormpress Ltd (edition printing and posting) — UK. For each edition they receive the print file (with the photos, captions and names printed in it) and the name and address of the person who receives it, use them only to print and post that edition, and delete them within 28 days of posting - Cloudflare (the website, and the internal tool we use to run the service) — US, certified under the EU-US Data Privacy Framework - Google Analytics (the website only, if you agree) We never sell your personal data. We never share your data with advertisers. ## 6. International Transfers East Hill is based in France and Marmalade’s main database is in the European Union. Your editions are prepared and printed in the United Kingdom. The United Kingdom and the European Union each recognise the other’s data protection law as adequate, and data moves between them on that basis. Transfers to providers in the United States rely on the EU-US Data Privacy Framework and its UK extension where the provider is certified, and otherwise on the European Commission’s standard contractual clauses with the UK addendum. You can ask us for a copy of these safeguards at admin@marmalade.family. ## 7. Data Retention Section 2 says how long we keep each kind of data. In addition: - When you delete your account, your profile, comments, reactions and moments that are not in an edition are deleted straight away. Moments already in an edition stay in your family’s archive; write to us if you need them erased - A backup of our database and files is made each night and kept in Google Cloud in London. Deleted data leaves the backups within 14 months ## 8. Your Rights Under both laws you have the right to access, rectify and erase your data, to restrict its processing, to port it and to object. You can delete your account in the app. For any other request, including data export, email us at admin@marmalade.family; we answer within one month. You can withdraw a consent or object at any time, and you can tell us what should happen to your data after your death. We make no automated decision that has a legal effect on you. If you have a complaint about how we use your data, write to us at admin@marmalade.family; we answer within 30 days. A parent or guardian may exercise these rights for their child, including access to, correction or deletion of the child’s data in photos or captions; a child who is now an adult may exercise them directly. In line with ICO guidance, we give particular weight to requests to erase data collected about someone as a child. ## 9. Children Only people aged 18 and over may create accounts; children do not use the service directly. Parents and guardians share photos of their children within private families, which is a core part of how families use Marmalade. Children’s data is used only within private families to provide the service, never for marketing, advertising, profiling or any other purpose. If you are not a member of a Marmalade family but believe a photo of your child has been shared without your consent, contact us at admin@marmalade.family. We will investigate and remove the content where appropriate. ## 10. Cookies and Tracking The Marmalade app uses no cookies. We do not use advertising cookies or collect the IDFA (Identifier for Advertisers). The usage events and crash reports the app collects are described in section 2. Our website, marmalade.family, uses Google Analytics only if you agree; the copy of this policy published there explains how. ## 11. Changes to This Policy We may update this policy from time to time. We will notify you of material changes through the app or by email, with reasonable notice before changes take effect. ## 12. Contact and Complaints For questions about this policy or your data, email us at admin@marmalade.family. You also have the right to complain to a data protection authority. In the United Kingdom this is the Information Commissioner's Office (ico.org.uk). Because East Hill is established in France, our supervisory authority in the EU is the CNIL (cnil.fr), which you can also contact. You can complain to the ICO or the CNIL at any time. The ICO usually asks people to raise a complaint with us first, and we will deal with it. ## 13. This Website This section is about the website marmalade.family. The rest of this policy is about the Marmalade app. The website asks before it uses Google Analytics. If you choose "Agree", Google Analytics sets cookies in your browser (their names start with _ga) and tells us which pages are visited, roughly where visitors are, what kind of device they use, and which website or link they came from. We use this only to see how people find Marmalade. Lawful basis: consent. The provider is Google Ireland Limited, and the data may be processed in the United States under the safeguards described above. If you choose "No thanks", Google Analytics does not load and no cookie is set. Your choice is kept in your browser's own storage, not in a cookie. To change it, clear the site data for marmalade.family in your browser and the website will ask again. The website is served by Cloudflare, which processes technical data such as your IP address to deliver the pages and to protect the site. The website has no account and no advertising. If you give your email address in "Tell me when the app opens" on the home page, we keep it, with the date, to send you one email when Marmalade is in the App Store and Google Play, and then we delete it. We do not use it for anything else. Lawful basis: consent. It is stored by Cloudflare (Workers KV). To have it deleted sooner, write to admin@marmalade.family. --- # Terms of Service Version 6, 28 October 2026 ## 1. The operator 1.1 Marmalade is operated by East Hill SASU, a French simplified joint-stock company with a single shareholder (RCS Paris 130 366 065, share capital 1,000 euros), registered office 173 rue de Courcelles, 75017 Paris, France ("Marmalade", "we", "us"). 1.2 Marmalade may be contacted at admin@marmalade.family. 1.3 These Terms of Service (the "Terms") govern the Marmalade app and the website marmalade.family (the "Service"). You accept them by ticking the box when you create your Account. A Member who has not ticked it, for example after signing in with Apple or Google, is asked to before using the Service. ## 2. Definitions In the Terms: - Account: a person’s own account on the Service. - Family: the private space shared by the Members who joined it with its Family Code. - Family Code: the confidential code used to ask to join a Family. - Member: a person with an Account who belongs to a Family. - Admin: the Member who manages the Family and its Plan, and whose card pays for it. - Moment: a photograph or collage shared in a Family, with its title and caption. - Edition: the printed magazine made from a Family’s Moments. - Recipient: the person, chosen by the Admin, to whom the Editions are posted. - Plan: the subscription the Admin takes out for a Family. - Cycle: a period of 4 weeks. - Printed: handed to the printer. - Chip-in: a payment by a Member towards a Family’s Plan. - Balance: the unused Chip-ins and credits held for a Family. ## 3. Eligibility 3.1 An Account may be created only by a person aged 18 or over. 3.2 Where Marmalade learns that an Account belongs to a person under 18, that Account is closed. ## 4. Account 4.1 Each Account is for one person, with accurate details. 4.2 Keep your sign-in details confidential; you are responsible for activity under your Account. 4.3 Keep the Family Code within the Family. A newcomer is let in by a Member already let in who is not the Recipient. Only the Admin may remove a Member. A Family has at most 50 Members, including the Admin and those not yet let in. ## 5. The Service 5.1 The Service lets the Members of a Family share Moments privately. Marmalade lays out each Edition, has it printed in England and posts it to the Recipient in the United Kingdom. 5.2 An Edition holds up to 25 Moments. 5.3 An Edition is printed only if the Family has shared at least 5 Moments since the previous one (clause 9.4). 5.4 Marmalade takes reasonable care to keep the Service available, but is not responsible for interruptions for maintenance or caused by networks it does not control. ## 6. Your content 6.1 You keep ownership of the content you share. 6.2 You give Marmalade a limited, non-exclusive licence to store, process, format, resize, display and print it, only to provide the Service: this includes passing it to our printing and hosting providers and showing it to your Family. 6.3 The licence ends when you delete the content or close your Account, except for Editions already made. 6.4 Marmalade never uses Moments for marketing. 6.5 Editions are laid out automatically. 6.6 You warrant that you own each Moment you share or hold the permissions needed, including those of the people shown. For a photograph of a child outside your Family, you must first have the permission of the child’s parent or guardian. ## 7. Prohibited content and reporting 7.1 You must not share unlawful content, including: content promoting terrorism; any sexual image of a child; content that harasses, threatens or defames a person; content inciting hatred or violence; private images shared without the consent of the person shown; and material copied without its owner’s permission. 7.2 Automated access, scraping and any interference with the Service are not allowed. 7.3 Marmalade does not review Moments before they are printed and does not use automated scanning. 7.4 A Member may report a Moment, a comment or another Member, in the app or at admin@marmalade.family, and may block another Member to stop seeing what they share. The Admin cannot block Members of the Family, but may remove them. 7.5 Marmalade examines every report. It may remove content that breaches the Terms, hold back an Edition for up to 30 days while it examines a report, and suspend or close an Account. 7.6 Marmalade tells the Member concerned its decision and the reasons for it, unless the law prevents it. That Member may contest the decision at admin@marmalade.family. 7.7 Marmalade reports child sexual abuse material to the competent authorities. ## 8. Photographs of children 8.1 You are responsible for having the permission needed to share an image of any child. 8.2 A parent or guardian who is not a Member may ask at admin@marmalade.family for a photograph of their child shared without their consent to be removed. Marmalade will examine the request and remove it where appropriate. ## 9. Plans and payment 9.1 Prices. There are three Plans, Weekly, Fortnightly and Every 4 weeks, at the prices in pounds sterling shown in the app before payment. A Plan is charged once per Cycle, 13 times a year (or once a year under clause 9.7), and renews automatically until cancelled. The first Cycle is charged at the start; the Admin’s card is then saved with Stripe and charged at each renewal, unless the Balance pays it. The Admin may remove the card or cancel the Plan at any time. 9.2 What a Plan covers. A Plan pays for the Family’s Editions; the app is not sold on its own. 9.3 Cancellation rights. Each Edition is made to your Family’s specification, from the Moments its Members share, and is therefore personalised goods. The right to cancel given by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to the Plan (regulation 28(1)(b)); we tell you so here, before you pay, as paragraph (o) of Schedule 2 to those Regulations requires. A payment is not refunded for a change of mind. You may end the Plan at any time; it runs to the end of the period paid for. Your statutory rights where an Edition is faulty, not as described or not delivered are not affected. Marmalade emails the Admin a confirmation, with the Terms attached, after the payment that starts a Plan, each renewal of a year and the first card payment after a take-over. By tapping the payment button, you accept the Terms. 9.4 Fewer than 5 Moments. If the Family has fewer than 5 Moments by a print date, that Edition is not printed, its Moments carry over, and the Cycle is still charged. If this happens twice in a row, the Plan pauses and nothing is charged (the Cycles of a paid year are not used up and the Balance is not drawn on) until the Family has 5 Moments by a print date, when the Plan resumes. Every Member is emailed when the Plan pauses and when it resumes. While it is paused, the Admin may end the Plan or move to one with fewer Editions. 9.5 Failed payment. If a renewal payment fails, nothing is printed until it is paid. The Family’s Moments are kept. 9.6 Price changes. Any price rise is emailed to the Admin at least 30 days before it applies (clause 14). A reduced or agreed price ending on the end date stated when it was granted is not a price rise: Marmalade emails the Admin before that date, and an Admin who cancels before the next renewal is not charged the higher price. A reduced price with no end date ends only after 30 days’ notice by email. 9.7 A year, paid once. On the Every 4 weeks Plan, the Admin may pay for 13 Cycles at once, at the price shown in the app. Nothing more is charged during those Cycles, and the Plan cannot be changed during them. The year then renews at the price then in force, unless the Admin has cancelled or chosen in the app to pay per Cycle. Marmalade emails the Admin the new price at least 30 days before; if it could not, and the Admin has not chosen the year in the app, the Plan renews per Cycle instead. An Admin who pays per Cycle may choose in the app to pay by the year from the next renewal. 9.8 Codes. Marmalade may issue codes, including a Family’s own code to pass on to another Family. A code, entered by the Admin or applied by Marmalade, may be used once per Family and gives a reduced price for a stated period or a credit to the Balance, on the conditions shown when it is entered or emailed to the Admin when Marmalade applies it. Credits have no cash value and are not refunded; a credit given for a payment that Marmalade refunds is taken back from the Balance. Marmalade may withdraw codes at any time, keeping credits already added (a credit not yet added is lost); a reduced price ends early only with the notice in clause 9.6. ## 10. Chip-ins 10.1 Purpose. Any Member may make a Chip-in. The Balance pays only the renewals of the Family’s Plan. 10.2 Order of payment. At each renewal, the Balance pays if it covers the renewal; otherwise the Admin’s card is charged and the Balance is kept. 10.3 Maximum. The Balance may not exceed the price of one year (13 Cycles) of the Plan; a Chip-in above it is refused. 10.4 [Not used.] 10.5 Cancellation of the Plan. If the Admin cancels and the Balance covers a renewal, the Plan may continue from the Balance, without charging the card, until the Balance no longer covers a renewal. 10.6 Refund of the Balance. Once a Plan has ended and nobody has taken it over, the unused Chip-ins paid by Members are refunded on a written request to admin@marmalade.family with proof of identity, shared in proportion to what each Member paid. Credits from Marmalade are not refunded. 10.7 No other refund or transfer. Otherwise, Chip-ins are not refundable or transferable. 10.8 Nature. The Balance is not a payment instrument, a wallet, electronic money or a payment service. It is not regulated by the Financial Conduct Authority in the United Kingdom or by the Autorité de contrôle prudentiel et de résolution in France. ## 11. Delivery 11.1 Recipient and address. The Admin chooses the Recipient, keeps the Recipient’s name and address accurate, and warrants that the Recipient consents to their use for delivery. A change of address applies to Editions not yet sent to print; an Edition sent to a wrong address is not reprinted free of charge. While the name or address is missing, the Plan does not renew, so nothing is charged, and a paid Edition is printed once they are added. 11.2 Posting. Editions are posted within the United Kingdom and delivered within 30 days of their print date; delivery times shown are estimates. 11.3 Edition not received, damaged or defective. If an Edition has not arrived within 10 working days of the date Marmalade said it was posted, or arrives damaged or defective, write to admin@marmalade.family, with a photograph of any damage or defect. Marmalade will reprint the Edition or refund its price. This is subject to your statutory rights, including the right to reject a faulty Edition within 30 days of delivery. 11.4 Death of the Recipient. If the Recipient has passed away, we kindly ask the Admin to tell Marmalade. Printing then stops, and paid Editions not yet Printed are refunded, a paid year included. 11.5 Death or incapacity of the Admin. If the Admin has passed away or can no longer manage the Plan, we kindly ask a Member or a relative to tell Marmalade. The Admin’s card is then no longer charged, and another Member may take over the Plan (clause 12.3); otherwise the Plan ends and paid Editions not yet Printed are refunded, a paid year included. ## 12. Cancellation 12.1 The Admin may cancel the Plan at any time, in the app or by writing to admin@marmalade.family. 12.2 Cancellation takes effect at the end of the Cycle already paid for, or of the last Cycle of a paid year. The Editions of that period are printed and posted, and it is not refunded, subject to your statutory rights and clause 12.4. If the Family is closed during a year paid by card, the Cycles not yet started are refunded pro rata to that card. 12.3 When the Admin cancels, the other Members are told, and any of them may take over the Plan before it ends, becoming the Admin. Their card is charged from the next renewal not already paid for (a year taken over continues per Cycle), and they accept the Terms by making that payment. 12.4 Refunds. An Edition that is Printed, or whose print file is being prepared on its print date, is not refunded. Any other refund is at Marmalade’s discretion, to the card that paid or back to the Balance. This clause does not affect clauses 11.3, 11.4, 11.5, 14.3, 15.2 and 15.3, or your statutory rights. ## 13. Liability 13.1 Marmalade provides the Service with reasonable care and skill. 13.2 Nothing in the Terms excludes or limits the liability of Marmalade for death or personal injury caused by its negligence, for fraud, or for any liability that cannot be excluded or limited by law. 13.3 If Marmalade fails to comply with the Terms, it is responsible for the foreseeable loss this causes, but not for loss that neither party could have foreseen, or for business loss. 13.4 Marmalade is not responsible for a delay or failure caused by events outside its reasonable control. ## 14. Amendment of the Terms 14.1 Subject to clause 14.2, the Terms that apply are those in force when the Plan is taken out or renewed. 14.2 Marmalade may change the Terms or its prices only for one of these reasons: a change in law or regulation; a change in the costs of printing, postage or payment; a change to the Service; security or the prevention of fraud; or correcting an error or clarifying wording, without reducing your rights or increasing what you pay. Changes are emailed to the Admin and to the Members who have made a Chip-in. A change in your favour, a change required by law, or a correction or clarification may apply once notified; any other change applies no earlier than 30 days after notice. 14.3 An Admin who does not accept such a change may cancel the Plan before it applies. While a paid year is running, the Admin may instead write to admin@marmalade.family before then; the Plan then ends and the Cycles not yet started are refunded pro rata. ## 15. Termination and deletion 15.1 You may close your Account at any time. 15.2 Marmalade may suspend or close an Account, or end a Plan, for a breach of the Terms or an unpaid renewal, after a warning and a reasonable time to put it right, unless the breach is serious or repeated. If a Plan is ended this way, the unsupplied part of a paid year is refunded pro rata, and the unused Chip-ins paid by Members are refunded under clause 10.6. 15.3 Marmalade may also end a Plan for any other reason, with at least 30 days’ notice to the Admin by email, printing the Editions due before then and refunding as in clause 15.2. 15.4 When you close your Account, you may ask for your personal data to be deleted, as the Privacy Policy explains. 15.5 If the Admin asks for a Family to be closed, Marmalade deletes its content, keeping only what the law requires. 15.6 Printed copies cannot be recalled, and archived Editions stay private to the Family. 15.7 Anyone may ask at admin@marmalade.family for their personal data, or their child’s, to be removed from archived Editions. ## 16. Governing law 16.1 The Terms are governed by the laws of England and Wales. 16.2 Nothing in the Terms affects your statutory rights as a consumer, including your right to bring proceedings before the courts of the place where you live. ## 17. Contact and complaints 17.1 Questions about the Terms or your personal data may be sent to admin@marmalade.family. 17.2 To make a complaint, write to admin@marmalade.family. Marmalade replies within 14 days. 17.3 If a complaint is not resolved, Marmalade will name an alternative dispute resolution body able to deal with it, and say whether it agrees to use that body.
